To summarise, the only data collected is the minimum necessary for the purpose of selling a vehicle and associated products such as finance, insurance or servicing. No data will be processed for any other any reason than what it was collected for to assist the smooth negotiation or repair of a vehicle. No data will be disseminated to commercial third parties nor sold or rented out except for sharing your data with the Peugeot Motor Company or Vauxhall Motors in relation to the sale and/or service of a vehicle.

What data is collected and why?

Data is collected for the purpose of selling, purchasing, servicing or repairing a vehicle and associated products such as finance, insurance or servicing.

Information that you provide to us when enquiring on our website, on the telephone, in person, or through the post includes the following:

  • Contact information including full name, address, telephone number and email address.
  • Information relating to your current or potential vehicle, including registration number, registration date, mileage, condition, service history or any other vehicle related issues relevant to the sale, purchase or repair.
  • Information relating to the financing of your vehicle including finance provider, deposit amount, monthly payments, interest rate, type of finance and length of finance agreement.
  • Information related to vehicle insurance and current driving licence details.
  • We use software tools such as Google Analytics to collect activity via our website for marketing purposes. We look at the following, but not exclusive to the channel the website was entered by, if an enquiry was made, session duration and pages visited. Telephone information including phone numbers and call duration that we use for training and quality control.
Where is your data stored and what do we do with it?

Any information is kept secure and safe by using an internal database which is a password-protected system. Where information is paper based this is either scanned and stored electronically or held securely. In order to prevent unauthorised access or data breaches we have effective procedures in place to safeguard information held on you.

If provided with your full details, we will contact you by email, phone or mail unless requested otherwise.

From time to time, we may contact you regarding offers, new products and/or recalls which we think to be of legitimate interest to those who have bought, or enquired with us before (if ticked on our form). Unless asked to unsubscribe from contact, clients who have bought, serviced or repaired with us will receive this follow up for 5 years and those who enquired, but never bought, serviced or repaired for 3.

Opt Out

Data may at any point be removed from the database or from marketing activity if requested. We have legitimate reasons to keep information about the vehicle sale, repair and/or service, but we will remove all connection with the client from this.

Reserve Online

On successful payment of the reservation fee, we will reserve your chosen vehicle (the Vehicle) for you for up to 48 hours (the Reservation Period) to enable you to speak to one of our sales advisors. If you make a telephone or dealership appointment within the Reservation Period, we will reserve the Vehicle for you until the time of your appointment, and extend the Reservation Period until your appointment. If you have not made a telephone or dealership appointment with the selling dealership within 48 hours to discuss the Vehicle, or you do not attend an agreed appointment within 7 days, the Reservation Period will end, your reservation may be cancelled and your reservation fee will be refunded to you with 7 days.

There is no obligation on you to buy the Vehicle, or on us to sell the Vehicle, as a result of payment of a reservation fee. You will receive a confirmation email when the reservation is effective. If you do not receive a confirmation email then your reservation has not been effective so please contact us.

There may be circumstances when the Vehicle has already been sold (before your reservation fee is paid) but the website has not yet been updated. If this occurs, your reservation will be cancelled and we will contact you to confirm this, and to see if we can locate an alternative vehicle for you. Your reservation fee would be refunded.

If you attend a telephone or dealership appointment to discuss the Vehicle, and decide not to proceed, the Reservation Period will end. If you purchase the Vehicle at that appointment, your reservation fee will be retained by us as part payment towards the Vehicle, and will be treated as a deposit on the Vehicle. If the Vehicle is not suitable, and you do not wish to purchase it, your reservation fee will be refunded to you.

We may cancel your reservation if you have reserved more than 2 vehicles at any one time or if the Vehicle is withdrawn from sale for any reason. Your reservation fee would be refunded in either case.

Any refunds can only be paid by the same method as the original payment and to the same card and will be paid within 7 days of request or cancellation of your reservation (or you confirming that you do not wish to purchase the Vehicle).

Home Delivery

Offer subject to availability within 30 miles radius of CA14 4HX is free of charge. Distances further than 30 miles will be subject to a charge of £1 per mile over and above 30 miles.

Distance Sale - Your right to cancel

A distance sale is defined as when a customer buys a car and the contract is not formed at our premises. This includes when an order is placed and paid for online, or by telephone, and the product is delivered to the customer's home without any face-to-face contact or collected outside at our premises.

You have the right to cancel this contract within 14 days without giving any particular reason. The cancellation period will expire after 14 days from the day on which you, or a third party on your behalf, collect or take delivery of your vehicle. To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement sent to the Sales Manager by post or email detailed below in the footer of this statement within the 14 day cancellation deadline.

Effects of cancellation

If you cancel this contract, we will reimburse to you payments received from you, including the cost of delivering the goods to you (except for the supplementary costs arising if you chose delivery over collection or a type of delivery other than the least expensive type of standard delivery offered by us). This reimbursement is subject to the following conditions:

  • We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. Anything over and above 250 miles will be considered unnecessary handling and will lead to a deduction of £1 for each mile driven over 250 miles. In addition, we will also be entitled to make a deduction for any damage or excess wear.
  • We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you the vehicle and all documents which were supplied including, but not limited to, keys, service histories, MOT and the V5 documentation.
  • We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement. This may include handing back any part exchange vehicle if still available and/or seeking payment from you to cover any negative equity.
  • We will withhold the reimbursement until we have received the goods and all paperwork back in good order.
  • It is your responsibility to return the vehicle without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of this contract to us.
  • You will remain liable for the vehicle and so for its tax, insurance, and any fines, charges or penalties until it has been accepted back to our premises.
  • You will have to bear the direct cost of returning the goods and take full responsibility for the safe return of the vehicle.
  • You are only liable for any diminished value of the goods resulting from the handling other than which is necessary to establish the nature, characteristics and functioning of the goods according to the previous reference to mileage.
  • Commercial vehicles and vans are excluded for the 14-day right to cancel.
Rights to Alternative Dispute Resolution (ADR)

We aim to resolve all disputes via our internal complaints' procedure. If you are not satisfied following the conclusion of this procedure, The Motor Ombudsman will offer free impartial advice and, when appropriate, an Alternative Dispute Resolution (ADR) service. It is important that you understand that any information you provide to us is your responsibility and must be correct. We advise you to keep copies of all documentation we send to you for your own records and protection. Please do not hesitate to contact us if you are in doubt on any aspect. The disclosure of information applies not only at the start of your finance agreement but also throughout the term of the finance agreement.

Making a Complaint

At Dobies Cumbria Finance Ltd, each of our customers is important to us and we believe that you have the right to a fair, swift and courteous service at all times. If there are occasions when we do not meet your expectations, please contact the Finance Manager either verbally or in writing to the above address providing details of your concerns. We will respond in writing within five days of receipt of your concerns; however we may need to investigate further. If this happens, we will write to you within those five days and advise you of who is dealing with the matter. We will investigate your concerns promptly and provide you with a final response within eight weeks of receiving your concerns. If you remain dissatisfied with our final response (at any stage of the process) you may be entitled to refer the matter to the Financial Ombudsman Service (FOS). You must refer the matter to the Financial Ombudsman Service within 6 months of the date of our final response.

Confidentiality

We treat the information you give us as private and confidential. We will ensure that your information is used in line with our strict confidentiality policies as required under the GDPR (General Data Protection Regulation). This information will not be passed to anyone else without your consent, unless we are required to do so by law. Under the GDPR you have the right to see the information we hold about you. Who we provide your personal information to

In order to process your application, we will share your personal information with credit reference agencies at the time of your application and for as long as you are a customer.

To do this, we will supply your personal information to credit reference agencies and they will give us information about you. This will include information from your credit application and about your financial situation and financial history. Credit reference agencies will supply to us both public (including the electoral register) and shared credit, financial situation and financial history information.

We will use this information to:

  • assess your creditworthiness and whether you can afford to take the product;
  • verify the accuracy of the data you have provided to us;
  • prevent criminal activity, fraud and money laundering;
  • manage your account(s);
  • trace and recover debts; and
  • ensure any offers provided to you are appropriate to your circumstances.

We will continue to exchange information about you with credit reference agencies while you have a relationship with us. We will also inform the credit reference agencies about your settled accounts. If you borrow and do not repay in full and on time, credit reference agencies will record the outstanding debt. This information may be supplied to other organisations by credit reference agencies.

When credit reference agencies receive a search from us they will place a search footprint on your credit file that may be seen by other lender

If you are making a joint application, or tell us that you have a spouse or financial associate, we will link your records together, so you should make sure you discuss this with them, and share with them this information, before lodging the application. Credit reference agencies will also link your records together and these links will remain on your and their files until such time as you or your partner successfully files for a disassociation with the credit reference agencies to break that link.

How long we keep your personal information for

We keep your personal information we use for up to seven years after the completion and closure of your account. If your application is declined, we will keep your personal information for six months to allow us to answer any queries you may have about your application. We do this on the basis that we have a legitimate interest in responding to query.

How we store your personal data

All personal information you provide to us (or which we obtain from a third party), will be stored on our secure servers. If personal information is provided in paper format, it is stored in a secure environment. We restrict access of all personal information to a small number of employees, and they may be disciplined or their contract of employment terminated if they fail to adhere to the policies and procedures in place.

Finance Terms

Dobies Cumbria Finance Ltd offers multiple financing options, that are available to different customers and as such each has different terms and conditions.

The eligibility criteria to apply for any Personal Vehicle Finance is; the applicant must be aged between 18 – 80 years old, be a UK resident and lived in the UK for the last 3 years and have a valid UK driving license. In some circumstances guarantees may also be required to progress an application for finance, but this will be assessed on an individual basis. All finance proposals are subject status and credit and affordability assessments are conducted to complete eligibility checks. Rates can vary to reflect any negative markers identified as an outcome of the required assessments, which will be discussed with you upon return of the proposal. The level of deposit will determine the rate of interest. The rate of interest: 1) 15% or more deposit = 10.5% APR, 2) 14.99% or less deposit = 12.5% APR. The age of the car will also determine the rate of interest. Cars 9 years and younger and the end of the terms will be either 10.5% APR or 12.5% APR respectively. Cars over 9 years old at the end of the term will be 12.5% APR or 14.5% APR respectively. Vehicles can be financed on Personal Contract Purchase over 25-48 months, only used against cars 3-48 months old and over £5,000.00. Vehicles can be financed on Hire Purchase over 12-48 months, only used against cars up to 84 months old and over £3,500.00. For cars under £3,500.00 the same terms apply but the standard rate at which interest is charged will be 19.9% APR. In exceptional circumstances 60 month HP agreements can be considered for affordability.

The eligibility criteria to apply for any Personal Finance is, the applicant must be aged between 18 – 80 years old, be a UK resident and lived in the UK for the last 3 years and be able to provide a valid form of photo ID. Personal Finance is provided between 1 and 7 years depending on the amount borrowed, which can be between £1,000.00 and £20,000.00. Debt consolidation will not be considered for the purposes of borrowing. All finance proposals are subject status and credit and affordability assessments are conducted to complete eligibility checks. Rates can vary to reflect any negative markers identified as an outcome of the required assessments, which will be discussed with you upon return of the proposal. The rate at which we charge interest is 6.9% APR.

When applying for Hire Purchase for the purposes of business, the same terms apply as above, however we may also require a director or owner of the business to personally guarantee the finance agreement. When considering business leasing this can be hired from 12 to 48 months subject to vehicle. Complaints

There are 3 options available at the end of a PCP agreement: 1) You can hand your car back with nothing further to pay (subject to mileage and condition); 2) Pay the optional final payment and keep the car; 3) Part exchange your car and use any equity towards a new PEUGEOT. If you switch your existing vehicle finance agreement by part exchanging with the retailer then please check that you're satisfied with the outcome e.g. are your costs under your existing finance agreement covered taking into account any deposits you've paid. Where your costs are not covered an additional payment may be required. You will own the vehicle at the end of a Hire Purchase Agreement.

The level of deposit will determine the rate of interest if financing a used vehicle with Dobies Cumbria Finance Ltd. The rate of interest is 1) 15% or more deposit = 10.5% APR, 2) 14.99% or less deposit = 12.5% APR for cars aged 9 years and younger and the end of the terms. The actual specification of a vehicle at the time of purchase may differ from that listed above and should be clarified at the time of your purchase. Any offers or prices are subject to change and do not constitute an offer to sell. Depending on the age of the vehicle, MPG and CO2 may be quoted using either NEDC or WLTP testing standards. Figures are provided for comparison purposes. Fuel consumption under real world driving conditions and the CO2 produced will depend upon a number of factors, including any accessories fitted after registration, variations in driving styles, weather conditions and vehicle load.
